Confidentiality

Investigations are conducted in private. Confidentiality is maintained in the course of the OCC investigation.

The Government department involved will know the name of the complainant, as they will need to produce the relevant files and answer questions. However, the Law prohibits them from breaching confidentiality provisions.

The OCC does not act on anonymous complaints although these are read to determine if a pattern of misconduct can be found. If so, the Commissioner can commence an investigation in the public interest on his own motion.
