Independence

The Office of the Complaints Commissioner is funded by the Legislative Assembly and does not answer to the governing party or any minister. It is an institution apart from the government but it plays a role in encouraging good governance.

It has been established in such a way as to protect the independence of the office. The following are some of the safeguards in exercising the powers of the office:

• The Complaints Commissioner reports directly to the Governor and not to any one Minister.
• The Office of the Complaints Commissioner is represented in the Legislative Assembly by the Chairman of the OCC’s Financial Oversight Committee.
• The Commissioner and the OCC Staff are appointed by the Governor and not the governing party.
• The Commissioner is appointed for a five-year term.
